It usually starts small. A like. A birthday text to an ex. A lunch that didn't get mentioned until it came up by accident. One of you says "that's not cheating", the other says "it is to me", and ten minutes later you're both on your phones looking for a referee.

There isn't one. But there is a way to find out where each of you actually draws the line, and it's a lot less painful to do it with a list than in the middle of an argument.

Short answer: It is cheating if it breaks what you two agreed on and you would hide it. People agree on sex, kissing and explicit messages. They split on flirting, exes and porn. And women call each behavior cheating more often than men do, in every survey we read.

How to use this page: Pick a theme. Answer each question separately with yes, no, or it depends, then compare. The questions where you disagree are the useful ones. For 16 of them, we show what national surveys found, so you can see where most people stand.

The three-question test

No list covers everything. When a situation isn't on this one, three questions settle most of them. Answer honestly, and pay attention to any "no".

Did we agree this was fine, or would we if we talked about it? If the answer is no, it is probably over the line for you two.

Would I do it in front of my partner? If not, the secrecy is the problem, whatever the act.

Would I be fine if my partner did the same? If not, you already know your own rule.

That last one is the quickest. Most people who ask "is it cheating if" have already answered it for the other person.

Phone and messages

The phone is where most of these arguments begin, because it's where something can be hidden in a second.

Social media

What surveys say: 16 of these questions, with numbers

Once you've compared your answers, it helps to know whether the two of you are unusual. Three national surveys asked people which behaviors they consider cheating. The US figures are from 2022 and 2017. The British ones are from July 2026.

The first column is the number of the question in the list above.

Three things to take from this table.

There is a clear top group. Sex, nude photos, explicit messages, falling in love and kissing all pass 80% in the US survey.

There is a real grey zone. Flirting, private confidences, dinner with someone attractive: people split close to half and half. If you two split there as well, you're a fairly ordinary couple.

The method of the question matters. A survey that offers "sometimes" gets softer numbers than one that asks yes or no. Don't compare the columns too literally.

In the 2022 US survey, about one in four people (23%) considered all ten behaviors on the list to be cheating. For what people do, as opposed to what they think, see how many people actually cheat.

The questions couples argue about most

Five themes come up again and again. For each, this is what the surveys can and can't tell you.

Flirting

Flirting is the least agreed-upon behavior in every survey. In the British one, 45% of people aged 18 to 29 called it cheating, against 20 to 27% in older groups. So if one of you shrugs at it and the other can't, you're both in large company.

Exes

No survey we found asks about texting an ex openly. Two ask about nearby situations: following an ex on social media (16% always, 45% sometimes, US 2017) and secretly messaging or meeting one (69%, Great Britain 2026). The word "secretly" does most of the work. A coffee your partner knows about and a coffee they find out about are two different events.

Porn

In the 2017 US survey, 53% said watching pornography without a partner is never cheating, and 19% said always. This is the widest spread of any behavior tested, and the one where a couple's own rule matters most. Note question 56, though: once you've agreed not to, the question is no longer about porn.

Dating apps

Questions 29 to 36 are the ones with the clearest majority after the physical ones: 63% "always" for an actively maintained profile in the US in 2017, and 80% in Great Britain in 2026 for using a dating app while in a relationship. It drops to 37% when the profile is kept "just to look" (US, Talker Research 2026). We go through these figures in a separate page on whether being on a dating app is cheating. This is also the one theme where a fact can be checked before the argument starts. CheatEye searches Tinder, with Bumble, Hinge, Happn and OkCupid as an option, for a profile matching a first name, an age, a gender and a location. When one comes up, you see the bio, the photos, when the profile was last active and where it was last used, and the person isn't notified. It doesn't read messages, doesn't search by phone number or email, doesn't show a live location, and a profile it finds may be old. AI chatbots

The newest question on the list. A 2025 study by DatingAdvice.com and the Kinsey Institute reported that 61% of single Americans consider falling in love with, or sexting, an AI to be cheating. In the 2026 British survey, 30% of adults called sexting with AI chatbots cheating.

Why men and women answer differently

YouGov's 2022 report puts it in one sentence: "Across each of the 10 actions, women are more likely to say the action qualifies as cheating than men are." If you and your partner disagree on a question above, this is the most likely reason, and neither of you is being unreasonable.

How to settle it as a couple

This is where the list earns its place. Pick an evening when nothing is on fire, and take it in five steps.

First, answer separately. Each of you marks yes, no or it depends for one theme. No discussion yet.

Second, compare. Skip the ones you agree on.

Third, take the disagreements one at a time. "What would bother you about it?" works better than "Why is that a problem?" The first asks for an explanation. The second asks for a defense.

Fourth, write down the two or three rules that came out of it. Exes, apps and phones are the usual ones.

Fifth, come back to it. Rules made at three months may not fit at three years.

Say you both answered "it depends" to question 22, the birthday text to an ex. Talk about what it depends on. Often it turns out to be one thing, such as whether it gets mentioned, and that one thing is your rule.

A disagreement on this list doesn't mean anyone has cheated. It means a rule was assumed and never said out loud.

Frequently Asked Questions

Is it cheating if nothing physical happened? For most people, it can be. In a 2022 US survey, 82% counted falling in love with someone else as cheating and 73% an intense emotional attachment.

Is it cheating if we never said we were exclusive? Not by the usual definition. Cheating means breaking an agreement. If none was made, the next step is to make one.

Is it cheating if it was only online? Surveys don't treat online as lighter. Sending nude photos (90%) and suggestive messages (83%) rank near the top of the 2022 US list.

Is it cheating if I only looked? It depends where. Fantasizing was called cheating by 16% of British adults in 2026. Keeping a dating profile "just to look" by 37% of Americans.

Who decides what counts as cheating? The two of you. Surveys show where most people stand, which is useful when one partner says "nobody thinks that is cheating".
